Union Leader Protection in Chile

Fuero sindical bars dismissing a union leader or candidate without a judge's prior authorization — we defend that protection, and we handle legitimate desafuero requests for employers.

What this involves

Fuero sindical exists so that an employer cannot use dismissal as a weapon against union organizing. It covers elected union directors throughout their term and for six months after, candidates from the moment an election is called, the workers who convene a new union's formation, and a workplace's union delegate where there is no formal board. Dismissing any of them requires a judge's prior authorization under a recognized legal ground — without it, the dismissal has no legal effect at all.

We represent union leaders and organizers whose protection was ignored, we bring anti-union practice complaints before the Labor Directorate and the labor courts, and we handle desafuero petitions for employers who have a genuine, documented ground to end a protected employment relationship.

Union Leader Protection — common questions

What English-speaking clients ask us most about this specific service.

Who exactly is protected by fuero sindical?
Elected union officers for the duration of their term and up to six months after it ends, candidates from the moment elections are called until the result, every worker who convenes a union's formation during that process, and the union delegate in a workplace without a formal board. The protection is broader than most foreign employers expect.
Can an employer ever dismiss a union leader?
Only with prior judicial authorization — a desafuero — granted on specific legal grounds and obtained before the termination, not after. A dismissal carried out without that authorization is legally void, entitling the union leader to reinstatement or full back pay for the protected period.
What counts as an anti-union practice?
Any employer conduct that obstructs union activity — pressuring workers not to join, retaliating against organizers, or interfering with collective bargaining — can be reported to the Labor Directorate and carries fines of up to 150 monthly tax units, independent of any dismissal claim.
Do you represent employers in desafuero matters too?
Yes. When an employer has a genuine, provable ground, we handle the desafuero filing and hearing correctly from the outset — which matters, since a rejected or defective filing leaves the employer facing reinstatement and back pay on top of the original dispute.
