Defending officials inside the Chilean public sector

Public, municipal, health and education officials in Chile answer to disciplinary rules most private-sector employees never encounter: formal sumarios administrativos, probity obligations under Laws 18.575 and 19.653, and oversight by the Comptroller General of the Republic. A proceeding that is mishandled early is far harder to fix once charges have been formulated.

We represent officials from the moment a proceeding is notified, through drafting the defense to formal charges, to appeals before the Comptroller General when a sanction is imposed unfairly. Each institution follows its own statute, and the defense has to be built around that specific framework.

Administrative Law in Chile — common questions

The questions English-speaking clients ask us most about this area.

What is a sumario administrativo and what happens if I am notified of one?
It is the formal disciplinary proceeding Chilean public institutions use to investigate and, where warranted, sanction an official. Once notified, specific deadlines start running for you to respond to the charges — missing them can limit your defense, so the response needs to start immediately, not once the process feels urgent.
Does every public institution in Chile follow the same disciplinary procedure?
No. Central government agencies, municipalities, and the health and education sectors each operate under their own statute and internal procedure, even though the underlying principles are similar. We adapt the defense strategy to the specific institution's rules rather than applying a generic approach.
What counts as a probity violation?
Chilean law requires every public official to act with integrity and put the public interest ahead of personal interest. Breaches include undeclared conflicts of interest, misuse of public resources, personnel or information for purposes unrelated to the role, and other conduct the Comptroller General or an internal proceeding can investigate.
Can a disciplinary sanction be appealed?
Yes. Administrative appeals and claims can be filed with the Comptroller General of the Republic against a sanction considered improper or disproportionate, and procedural defects identified in the original proceeding can support having it set aside entirely.
