Marital Property Division in Chile
Dividing what a marriage built together under Chilean law — property, accounts and debts — whether both sides agree or the split has to go before a court.
What this involves
The sociedad conyugal — the default property regime for marriages in Chile that made no other arrangement — pools most assets acquired during the marriage into a single common estate. When the marriage ends, that estate has to be formally liquidated: identified, valued and divided according to law, not according to whoever holds the title or the bank account at the time.
We handle this both by agreement, through an out-of-court liquidation by public deed when both parties are willing, and through judicial partition when they are not. Either way, the work is the same at its core: finding every asset and debt, getting it valued correctly, and making sure the division actually reflects what each spouse is legally owed.
What we handle
Asset identification
A full inventory of real estate, bank accounts, pension funds, vehicles and other property acquired during the marriage, so nothing is left out or undervalued.
Out-of-court liquidation
Drafting the public deed of liquidation by mutual agreement — the fastest and least expensive route when both spouses are willing to settle.
Judicial partition
Representing you before the court-appointed partitioner when there is no agreement, to secure a fair and properly documented division.
Valuations and debts
Coordinating independent appraisals and establishing how mortgage and other marital debt is allocated between the parties.
Compensation claims
Pursuing recompensas — reimbursement for separate property contributed to the common estate — and compensación económica where one spouse sacrificed earning capacity during the marriage.
