Challenging Paternity in Chile
Disputing paternity in Chile is possible, but the deadlines are short and the court weighs the child's interests first.
Contesting legal fatherhood
Chilean law starts from a presumption. A child born during a marriage is presumed to be the child of the husband, and a man who formally acknowledges a child is legally the father. The rules on filiation are in the Civil Code, as reformed by Ley 19.585. A challenge (impugnación) asks the Family Court to declare that the legal father is not the biological father.
Who may file, and by when, depends on the situation. Fathers, mothers and the child have different standing, and the time limits are short and can start running from the moment someone learned the relevant facts. Missing a deadline can close the door even when a DNA test proves the case, so the first step is always to check the dates. Because these cases are sensitive for the whole family, we handle them discreetly and explain the consequences before any filing.
Why the clock matters
Chile limits how long a person has to dispute paternity. For the husband, the period is short and counts from when he learned of the birth. The mother and the child have their own rules, and the child has a chance to act after reaching adulthood. The exact period depends on the action, so we do not rely on rules of thumb.
Courts have reviewed whether these limits are compatible with the constitution, and they remain in force. If you suspect the deadline has run, still speak to us: sometimes a different action, or a different starting date, is available.
DNA, evidence and the child's interests
Genetic testing is the most reliable evidence in Chilean filiation cases, and refusing to take a test can be weighed by the judge against the person who refuses. Courts also consider the child's right to identity and the stability of the family bond that already exists.
A ruling changes more than a name on a certificate. Support obligations, inheritance rights and the child's surname can all change, and the Registro Civil must record the judgment. For a child who has lived with a man as a father for years, judges consider the human reality as well as biology.
